IMO - technically QUT could take the IP and start again. But there would be a legal action seeking redress - funded by one of the litigation funders. The threat of such action dragging on interminably would hasten settlement in favour of existing s'holders or more likely, prevent it happening - by drawing things out QUT would kill the product.
