Duds or not, the company still has to disclose. If they haven't got the assays back by now, then they should disclose a delay, by doing one of those "market updates" that companies do. If they have got the results back, but don't like them, then I presume they'd be up for a class action due to non-disclosure, and the market trading in an uninformed manner.
