Yes I agree with you completely. However, a good statistician would be able to apply the correct tests to maximise the validity of the trial. There are well over 30 tests that could be used.
This trial is critical and everything hinges on the correct application of statistics. Also what is written and how it is written. They get one chance to not mess this up. .... I hope the directors understand the gravity of what they are about to release..
Take your time, but get it right...
