    Having read part 9, s611 of the CA I don't think an incorporated entity can creep, only a natural personal/partnership but again my interpretation may be wrong. 

    I know they haven't crept, just curious about the relevance of allowing them to acquire up to 25% under the agreement when the takeover provisions would apply if they were to exceed 19.9%.
