Can only keep it short mate because I have to go. We are sowing here and I have to take a truckload of seed and fertilizer to another property of mine to keep them going.

As for what you are asking of me, well mate it is very simple indeed. I will therefore try to explain it to you in the best way I can.

Now Ash, it shows/prove that all the arguments put forward by CTP until now have fallen into deaf ears as being totally baseless, and it also proves to me that the argument about CTP not having any assets in the USA and as such not been liable or been forced to meet any damages should we loose the Court Case and being awarded damages against us, it is also a big and baseless furphy.

It also tells me that not only we lost this appeal but the one before as well and ordered on both cases to pay all costs too...So.......................?

I took the time of reading that judgment, unlike many others, and I have noticed therein that the Judges not only threw that argument out of the window, but they have also quoted some solid and past precedence cases to support their findings.

Perhaps our Lawyers didn't do as much in depth research as what the Judges in that Appeal did, but who knows.....not me. Only time will tell.

It also means to me that, unless something is done to stop it on it's tracks, we will now have to face the music in that Texas Court and see what the judge and/or the Jury will have to say about it.

While it is clear what it is stated therein, it is also clear IMO that we haven't faced the music and no one knows what the end result will be. Nevertheless we will have to front up and fight it and see as to what will happen from there.

I am not saying that we have lost the case already or that we will loose it, but it means that we will have to fight it in Court and in the way these sort of things are handled in there, it worries me a little. Especially if we are to loose and where a jury might be the one stating how much damages, IF ANY, we will have to pay out.

There are more points in that judgment which will need to be shared, but I simply haven't got the time to do it now so it will have to wait until later or at another time...... The likes of fair play has also been made very clear indeed.

But rest assured though that I didn't come down with the last shower of rain either and that I know a little about these sort of things.
