THE COURT ORDERS THAT:
1. The parties exchange categories of discovery by 26 September 2008.
2. The time by which the Applicant is to serve the evidence of Ian Prider, Trevor Prider and Keith Jackson is extended to 29 September 2008, and the time by which the Applicant is to serve the remainder of its lay evidence in reply is extended to 10 October 2008.
3. In the event of a dispute as to whether a category or categories of documents should be discovered, any application seeking discovery by a party or parties of a disputed category of documents is to be filed and served by 10 October 2008.
4. The parties serve verified lists of documents in relation to categories not in dispute on or before 31 October 2008.
5. Inspection of discovered documents to take place by 14 November 2008.
6. The proceedings be listed for further directions at 9.30am on 6 November 2008.
7. The Court notes that the second tranche of security for costs to be provided by the Applicant for the First and Fourth Respondents is payable at the completion of service of all lay evidence. The parties agree that this is to be provided by the Applicant on 10 October 2008, irrespective of whether the Applicant seeks leave to serve any lay evidence subsequent to that date.
8. The Court notes that the second tranche of security for costs to be provided by the Applicant for the Third and Fifth Respondents is payable within 7 days of today’s date on the basis that orders for discovery have been made.
9. The parties have liberty to apply on 3 days’ notice.
