My understanding of this procedure is that the courts will make a decision - not FIRB.

In assessing whether or not to approve the Scheme Booklet and order a shareholders’ meeting to be convened, the Court will consider the structure of the proposed scheme, the adequacy of information and disclosures in the Scheme Booklet, and any objections or submissions from ASIC or other parties. Nevertheless I expect that the acquisition will be executed with an amicably solution for all parties involved by the end of 2018.
