Thank you, and a big effort on your behalf. I actually work in an area of 'reasonable person' decisions and the only way you can be sure is to look at the case law. The best predictor of future behaviour is past behaviour. I know the case law backwards but I am still surprised by some decisions which set new case law. The actions of a reasonable person will always carry a shade of grey. At the extremes I think it is quite clear and relatively easy to second guess a reasonable person but at the margins not so easy. Any how I digress and I am afraid that I have put a red herring in my reds herring. Thanks for your input.
