They can hide under the cover of "commercial in confidence". If the negotiations are continuing then we won't know about any counter offers until the deal is done.
It is a perfectly legitimate practice.
Continuous disclosure requires that the outcome is tabled, not so much the machinations or the process leading up to it.
Shame really, because I'd happily take on tea lady duties just to listen in to what is going on.
