I Googled Justice Gleeson's background, and I doubt if she is a dyed -in-the-wool lefty – see
https://en.wikipedia.org/wiki/Jacqueline_Gleeson. She was appointed to the Federal Court by Attorney-General George Brandis on 15 April 2014. Brandis was a Liberal senator between 2000 and 2018. Mind you, in my book, the Liberal party is left wing.
Even if the Federal Court rules against TGA, if TGA had the stones to fight the good fight in the High Court, it should win, IMO, just as ANZ won against Maurice Blacburn in the bank-fees class action, when ANZ appealed the ruling of Justice Michele Gordon of the Victorian Branch of the Federal Court.
Whether a feel for what the possible class-action outcome effects current investor sentiment, I cannot say, but the SP is showing signs of upward creep. I am usually disinclined to ascribe SP movements to the somebody-must-know-something causation, but it is obvious that folk involved in the forensic joust would know relevant facts before we mug investors are informed.
