The 2016 SIAC rules are not the rules which apply to this arbitration. The 2016 SIAC rules came into effect on 1 August 2016 and these rules apply to “any arbitration which was commenced on or after that date”. (SIAC 2016 Rules (1.2)) As POH commenced arbitration on 6 January 2016, the previous 2013 SIAC rules apply.

The fact that the 2013 SIAC rules apply doesn’t change what you have posted about the award and appeal in this post as the 2016 rules you posted are reflected in 2013 SIAC Rules 28.1,28.2 and 28.9.

The SIAC rule for Summary Procedure/Early Dismissal was a new addition in the 2016 rules. Therefore, it does not apply in this case.

The mean and median duration of an SIAC arbitration (13.8 and 11.7 months respectively) as calculated and published by the SIAC means little to us at this stage other than a sick joke. Today we officially mark the 34 month mark in this arbitration. If we are still waiting on this decision on 10 December, perhaps we can celebrate that POH has been a party to a 3 x median duration SIAC arbitration…
