Also regarding the BoA substantial shareholder notice.

I think the last two substantial shareholder notices are based on BoA returning loaned stock so that its owners could pick up the rights. Then once the rights were assigned the stock re-loaned back to BoA (under some type of contractual arrangement). Whether or not this stock is currently being sold short or not would depend on BoA's 'short term' outlook for the stock - which like you I think is positive (therefore until there is a significant rally BoA would be mad to short it!).
