Problem being that, even with the issue of an unqualified audited set of financial figures, in the normal course of events i think the directors of a company remain ultimately responsible for the finances of that company. So, if Huong were dudded by the audited figures, NLX can't easily turn around and blame the auditor.

    On the other hand, courts are usually very hesitant to overturn a business-to-business transaction or award substantial damages. The rationale is that both companies have their lawyers, auditors, etc. and the courts shouldn't interfere just because Huong got the raw end of the deal. For Huong to win the damages they are claiming, there would have to have been huge incompetence and/or deliberate misrepresentation on the part of NLX. Given the company's history, unfortunately that's not necessarily out of the question!!!
