Barnes and Pinnacle.. the number ONE and number TWO culprits in this current action..The only ones who had a fiduciary duty and therefore the only ones who could potentially breach it!!.....Again what did chm settle for...$6 mill.....the lesser culprits...If indeed proved..Grim (who was not a director of chm and therefore had no fiduciary duty to breach!)and his coy....Naturally any settlement would be less than Barnes if indeed settled.. Then we have Murchison, who had clean hands and no knowledge!!!! So likely even less exposure....Inoncent company, unknowingly benefitted from a few hundred thousand of another coys money, because a dodgy director feathered his own nest. which he has now payed for, a director of Nicu/mmx may also have to pay up for using murchison to feather his nest also..but MMX the coy was obviously quite inoncently used by a couple of greedy scheming charachters and therefore has no case to answer...but will however have to repay any money's inoncently benefitted from...plus interest......and may then win damages and recompense from grim and barnes who they have croos sued.....Chm get their win...but from barnes (their own director) and Grim (a former nicu director)....Hope that helps with the law Gard's....Top loss to MMX 10-20 mill either settlement or judgement...Tell us your figure and let's see who is closest in the end...and will then decide bragging rights..Are you game????
