I too have have some experience with litigation funders but your experience and observations are much more on point.
They are a great start and I will follow them up.
It is possible that the process followed and the conduct of the Directors and KPMG are completely above board in this matter.
While this may be so,there have also been many attempts that I am aware of to have questions answered on specific issues which I thought were not only reasonable but should have been answered within one head of duty or another. To my knowledge, there have been no responses provided beyond the recommendation by the Directors and the attached valuation.
If I was the position of the Directors (and many of us have held some statutory and reglatory responsibilities in our time), I would act both cautiously and conservatively and leave no stone unturned to protect myself and my wider interests including the shareholders I represent given our increasingly litigious society.
