At 91.46%, it is almost certain Glencore are going to get the numbers for a CA.
One approach that has not been raised is the matter of a potential class action against KPMG (for their bodgy report) or those directors who worked themselves to the bone in defending us shareholders by accepting the first offer - wow tough work if you can get it! Toss in Glencore for that matter.
Generally, the most risk free is to use a litigation funder. Even if one gave away 75% of the damages to the litigation funder, 25% of something is better than 100% of nothing.
Of the two, KPMG is probably the more vulnerable but who knows in a law court.
The dollars would be clearly large in victory and worth a run.
Any appropriate litigation funders out there that people know?
