Laches is a Legal Doctrine derived from the French (where this case will be heard). Basically, means FAR wasted her time NOT pursuing their legal claims early - they had more than 3 months to launch legal actions (but announced they "preserved their rights"), before the start of the Appraisal programs which JV parties (including WPL) spent over $100M. And only pursued it after the appraisal programs.
That is LACHES!!!
