SMM must have some reasonable evidence of a breach of the JV to consider a high court challenge in the first place. They also have the opinions of 2 senior legal counsel that they have a strong case. And we won't hear of it until well after the offer closes...and the ALP decision.
Add to that the new JORC upgrade, which I believe from anecdotal evidence is going to be a monster, and time will soon tell that PDN's offer is woefully inadequate.
In fact with 100% of Mt Isa, the abandoned no-new-mines policy, a massive resource upgrade and new discoveries in their other quality tenements then its possible that PDN could become a target of SMM.
