Well yes, its still technically "pending", as the case file hasnt been closed. "Not patentable subject matter" and "not novel" is pretty damning though.
Look at the USPTO report from 2013 and look at the number of novelty objections in the report. Looks like the prior art has the idea well and truly covered.
IP Australia arent idiots. I cant see a response from the Company to IPA seeking to challenge the examination - and its been 3 months. I think the statutory response time is about 3 months, or IPA will close the file.
