they make the rules regarding the protection of the environment
they have a legal mandate and a moral obligation to do this

The EPA established an EES for the MMRT project which all parties must adhere to,
as a measure to protect the population from environmental vandalism
The EES is very clear as to how PASS must be disposed of and
failure to dispose of the PASS in the prescribed way will attract fines and penalties for the disposer .
Failure to enforce the prevention of the prescribed disposal method will seriously jeopardise the EPAs environmental mandate (which is something I don't think will happen)

So I cannot see any other way to dispose of PASS for the MMRT as that indicated by the EPA
