I think you'd be crazy to go to court before ASIC have said anything. If ASIC don't think they can get a criminal prosecution you'd be hard pushed to get a civil case away.
The lawyers will be very gung-ho - but remember if you lose you'd have to pay PDY defence legal bill which could be substantial.
