One point id like to highlight for those who havent seen this yet or for those who havent read it yet is point 5.2 see below - This is found on page 23 of the referral.
5.2 Proposed action IS NOT a controlled action. The proposed drilling program is not likely to have a significant impact on any matter of national environmental significance, for the following reasons:
The proposal comprises the drilling of only one, relatively shallow, well and will involve only water-based drilling fluids. The area affected will be small and the drilling fluids are recognised to have minimal impact to marine environment (Hinwood et al., 1994).
There are no World Heritage Areas, National Heritage Places, Wetlands of International Significance (Ramsar sites) or threatened ecological communities within and immediately surrounding the proposed drilling area.
No or only very low numbers of Threatened and Migratory species are expected to occur within the proposed drilling area during operations. Management measures will be implemented to ensure the proposed activities have no significant impact on migrating humpback whales.
The proposed drilling area is unlikely to have particular importance to any marine species due to the distance offshore, depth of water and absence of any significant geomorphological features of importance to marine fauna. The proposed drilling program has a low potential for impact given the management measures that will be applied to all aspects of the program. All operations will be conducted in accordance with relevant legislation and associated guidelines to meet the requirements of the OP Act.
