Your interpretation is incorrect

The requirement is to release at a minimal the data and an explanation of the results which is called 'publication'. That does not include what NTI is going right now which is a more intense three month publication of results with the attempt to get that publication into a leading scientific magazine.

If your results are poor you would release the result with the required minimal explanation and that would suffice 'publication' by the HHS.

NTI by spending three months preparing for publication is obviously doing something else.
