PPN recently announced that last years AGM would be held on Friday 31 August @ 11:00 am. However I have not yet received the official notice for the meeting and the 28 day notification period has either already expired or will expire after today's mail depending on how you interpret the legislation.

Paragraph 69.1 in the PPN Constitution says:
"At least 28 days' notice of a general meeting must be given in writing to those persons who are entitled to receive notices from the Company."

Section 29(1) Acts Interpretation Act 1901 says:
"Where an Act authorizes or requires any document to be served by post, whether the expression “serve” or the expression “give” or “send” or any other expression is used, then the service shall be deemed to be effected by properly addressing, prepaying and posting the document as a letter and, unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of post."

Item 4 of Section 36 Acts Interpretation Act 1901 says:
"If the period of time is expressed to end at, on or with a specified day, then the period of time includes that day."

Some might argue that notice of a meeting should not include the day of the meeting. However, if 28 days notice is required for a meeting to be held on Friday 31 August 2012, and the day of the meeting itself can be counted as DAY 28, under a beneficial interpretation of Section 36 of the Acts Interpretation Act 1901, the notice must arrive in today's mail or it is out of time.
