It all depends when the ruling was lodged to be honest. I suspect they will have their lawyers preparing the application as we speak and will then lodge the ruling as soon as the vote is successful at the end of the week.
It could be the case though that they were extra prepared and lodged it earlier, although it is hard to do this until all the facts have been settled. I suspect the fact that the amount of the proposed distribution changed last week would mean the ruling hasn't been lodged yet.
There is also a chance, albeit slim, that the ATO could get their act together and issue a ruling in less than 3 months. But in my experience, that would be a first!
The ruling should not be a contentious one, so they will definitely get it. The ATO don't do favours for anyone though, so it is just a timing issue. It is better to wait and get certainty though rather than getting hit up for a tax bill down the track.
