I really cannot see how you can say:

"However, if being paid monthly, the requirement under Industrial Law is to pay mid month for the month being worked. This means effectively 2 weeks in arrears and 2 weeks in advance.
Which is effectively neutral." "This isnt my opinion that i am presenting here, this is fact under Australian law"

If it was under Australian law then you would not be allowed to change it - if it was part of an award you would not be allowed to unilaterally amend it either.

So I am left to think its a negotiated contract. At a level of professional worker you would never persuade me to pay them on that basis - It is neutral but not neutral in regard to to the company. What it would mean is that you have paid that person for work to be delivered at a future date. I would not have been happy with that as an employer as my risk is the person does not complete the work leaves or gets fired and i have to recover from someone.

I have seen these change from monthly to fortnightly but in each case its been for work periods already completed.

If its a negotiated contract then I am sure you can renegotiate and if I was a director I would have suggested pay everyone on a fortnightly basis rather than have paid in advance for work not yet performed.

I cannot see this company committing an unfair labour practice.

However I sold out as there is just too much noise and then in AGM pack they lowered their expectations for 2015.
