Well, that doesn't make much sense as the reason they are probs using the daughter/flat case because they are not allowed to take the case to court without a test case. I'm not sure why you would think that they will be treated by the ATO on an individual basis, in my opinion as the trust is actually part of the entire domacom fund trust that this would set precedent for the whole fund, but I'm sure dcl's lawyers disagree with your view.
And if my take is right, you must agree that winning this court case would be extremely beneficial for investors. Yeah I have read the article, and I don't think that it would be closed because it isn't actually loophole, the ATO have this exception in for this exact reason. Also, considering that the liberal government actually support something along the lines of letting young ppl access their super for housing, I doubt there would be much political support for such action.
What details have they not disclosed to the market may I ask?
