It's not ripping it off, the patent expires next year, when a patent expires it becomes public domain i.e. anyone can have a go at it. Plus there have been several expired patents for upgrading the coal. The company has currently expanded on those expired patents to come up with the latest but there's nothing stopping anyone from coming up with a different method that expands on an expired patent and patenting that.
