one thing as occured to me from your post. EMS may not want to prempt anything by putting out an announcement on BP that could be considered a breach. i.e. Let's sit back wait for the results and if the Administrators think they can comply at the time we require the product, then manufacture it please!!! Otherwise you are in breach.

In the meantime we engage Therapex on a fee for service basis - no exclusive rights or JV which could also be considered a breach of the BP agreement. That may come later of course...

Meanwhile we merely confirm that we have never disputed BP's rights to manufacture or to transfer the right...I cant beleive this has only just occurred to me. Sorry if this was bleeding obvious to other EMS posters.

So if it is the case then we may not get an announcement on the BP issue until D Day i.e. production time. And how that fits with a trade sale - not sure??
