HC44 I don't think it's that easy. If it was, anyone who had debt can simply choose not to pay it by funnelling their assets to their mother, or funnelling their debts to their friend. As people have posted here earlier, there is a concept in law called "lifting the corporate veil" whereby the courts will disregard the limited liability status of a company and pretend it doesn't exist, if it can be shown the company structure was being used to avoid contractual obligations.
I think in other words - if you've agreed to something the courts will hold you to it.
So as Bolton has agreed to pay Brisconnections $77m on specific dates by buying the BCSCA units last November, it won't be easy for him to "choose" not to honour that agreement.
