c/ possibly 2 cheques totalling $153,000 of chm money ended up with Jack hills vendors...grim and barnes say it was a loan..The vendor receiving it testified to this...some doubt there as it was not documented..But was it the INTENTION....
To get an award of a share of Jack hills and not simply money back with interest plus some damages, you have to prove that the funds were put to the purchase of the asset you are seeking a slice of,and that they were illicitly gained...If it was a loan, it doesnt count that way...however lets concede this point...Still only 153k of an anywhere between possibly 10 to 14 million purchase price..(depending on whos view you take).constructive trusts (which are rarely awarded as remedy) are, when used, applied in percentages of each parties contribution..so still not much of a percentage...Barnes and Grim not testifying because there is no real need, not much to be said about the $153,00...
Share sales..Lease sales...profits injected in to mmx etc...may have happened, however we know that any proceeds from these cant be shown to have gone into purchase price of project to the tune of any more than $500k (as conceded by CHM themselves) hence can still only get up to about 3 to 4%.... and this not taking into account over $50 mill spent on project to get its value to where it is today..which is all MMX input.....very difficult to see anywhere near 100 mill more likely at best 20 - 35...and believe CHM would have taken around 50 in a heart beat but wasnt offered...But DYOR I have...
Any supposition as to where CHM might have been today is merely that..I believe when all this was happening CHM was a small nearly broke company anyway..which was itself having financial difficulty's...and obviously with very poor management/director(s) not that its really relevant....
It all looked bad for O.J everyone felt in all liklihood he committed the murders..there was lots of circumstantial evedence which screamed he did it...he had the motives...We all knew he was guilty...Just couldnt be PROVED conclusively no matter how much the probabilty was there..No choice but to say through gritted teeth..NOT GUILY...
