So HFT's are ahead of the regulators (sheesh)! Lets be real here. There are plenty of examples of Company execs and their "friends" that seem to have access to speedy info just prior to most others and this enables or at least sends a tracer out for HFT's to outperform most day traders etc. As for those who go long and max out on due diligence, they inevitably, do not suffer the daily flogging you can get on daily trades if you are not seriously switched on.
