you can't put any wieght on mmx asking for a deferral when new information is introduced. that is just good practice to make sure you are properly across the information. chm would do the same (and have) when mmx introduces new material.
who was the counter party with evens and koh in this signed agreement you mentioned and what were the conditions that had to be met?
