I have actually lodged patents and i understand the process.
Some things that are claimed in a patent - such as the method of using a mobile device to scan - may not be considered novel enough to stand up when challenged.
Unless this is a unique and novel scanner or scanning process (and it doesn't appear to be in the us patent link you posted) - after all scanning a security code has been around in Supermarkets for the last 20 years plus.
so that part can't be patented.
Obviously Nexbis is protecting their forensic level 3 encoding process - which may have a unique and cost effective way of encoding, which allows for a competitive cost advantage, a high level of security and thus allows for high margins .
The ETC shareholders have done their due diligence plus we are not living in Siberia, there are corporate governance rules that apply.
