ahh ok they're just the guides, the rule is 3.1A.2. That rule relates to the ASX' power to make a determination, it doesn't impact on LEI's disclosure obligations. A T/O is information protected under privacy.
An example of how that would apply. Company A is preparing to make a takeover of company B at $11.20. Some nuff from company A has released the information either deliberately or by mistake. ASX would then have the power to make a determination that the information has ceased to be confidential and would then place the shares of both stocks (if both listed) into pre.
