Discussions have been in progress with the WA Department of
Indigenous Affairs (DIA) since early February 2008 regarding a
lodged Complex Heritage Site over Mt Forrest. A determination of
the site is required before the s18 application (lodged with the DIA
in March) can receive a recommendation by the Aboriginal Cultural
Materials Committee (ACMC) to the Minister DIA.
Mindax have had extensive discussions with and made a number
of submissions to the DIA on the matter, most recently presenting
a review and opinion by a leading anthropologist for consideration
by the DIA in determining the site. We have been advised still
further information is required before the ACMC would be able to
draw a definitive conclusion. Unfortunately the timing of this advice
has precluded presentation of new data to meet the time line for
the September meeting. The matter is complex and sensitive.
The Company is extremely disappointed by DIA’s decision. It is
Mindax’s intention to comprehensively review the available
information inclusive of legal opinion for determination at the
October meeting and we have advised DIA accordingly. The time
line for the presentation of this data is understood to be 22 August.
Mindax remain strongly of the view that exploration drilling
will be allowed and have the support and encouragement of
the registered native title claimant in this matter
