Notwithstanding all my recent posts about not having an issue with the funding facility. The two shortcomings are these (without being privy to the contract):

1. Non-use of an average SP - weighted average of X preceding days;

2. Non-use of escrow.

The above is assuming that the above 2 conditions are not part of the agreement.

Re 1: After today's announcement I think we can assume 1. was not put in place.

Re 2: We cannot be certain about who did the selling today.
