It might be worth noting that on page 2 of the CHM quarterly activities and cashflow report they stated quite clearly the following:
"During the quarter the company discharged a loan facility provided by ILP in the amount of $326,714.06".
Whether CHM owe ILP any further funds I do not know but it would also appear that Cape Lambert spent some months doing both legal and mining related due diligence.From my limited knowledge of Mr. Sage's background and achievement he does appear to be quite a "savvy" person and I doubt he would have parted company with any money if he knew that there was a "hidden bill" in the cupboard.
The matter will be resolved by Friday at the latest and that I know for sure.

P.S. A previous post suggested that MMX would appeal any decision that is made in favour of CHM (perhaps apart from a small sum) - from my understanding this case will not be open for appeal - what the judge decides is final. I stand to be corrected by someone who understands that part of the legal process as opposed to meaningless guessing.
