Tabang coal has proved to be cheap to mine and get onto a ship and it sells as a stand alone product even though it is a low grade fuel - there is no need for any of the coal to be upgraded to make it saleable and profitable.
Surely it (the court-case) boils down to when was this inconvenient truth discovered?, and why didn't the legal agreements envisage and make provision for such an eventuality?
