What about the purported quantum of the claim from the NSW govt? Who/what is underwriting this possibility? Half of an illiquid JV. Seems the overwhelming majority of the money for half the business will have circulated back to Duncan Saville's interests and any damages will rely on half the JV generating cash or the half then being sold. And guess who/what is the only logical buyer?
Alternatively ERG wins or negates the litigation and there is a true upside. ERG shareholders had better hope its legal filing on 9 May is soundly based. Surely the NSW govt is only grandstanding in claiming more than the liquidated damages they say they have already grabbed. Seems like a cover for other failings. Does anyone know what exactly they have claimed?
