All I understand that this is not a final position that is binding on the company . An updated rehab plan has been drafted by the company and it has to be sent to a number of parties for comment . The EPA would be one of these parties and has responded indicating that they do not believe the bond is sufficient but I understand they have not provided detailed calculations just an opinion that its not enough . The company has then been given an opportunity to respond to as to why they believe it is detailing the calculations etc. The environmental court then considers all the responses and then make a determination . There has been a couple of mines in Sweden that closed in an uncontrolled way leaving a clean up cost to the state so this of course will effect the EPA's concern as to the bonds held but my understanding just like the recent appeal the court reviews all the information on a fact based analysis and then makes a determination
