CHM is clearly the company with nothing to lose in this contest ...MMX is desperate to hold onto ownership because their current insto holders, cHINESE AND aUSSIE, will chop heads from the board if they lose a couple hundred mil TO A COMPANY THEY WERE ASSURED HAD NO CASE.
In fact, that's why they will settle...the risk of a court ordered sum is too great a burden. They (and Cranswick) can then rationalize it as a cost saving exercise to rid the company of a nuisance case in an attempt to save face and their jobs.
The only question is how much? Considering CHMs' published demands, even a heavily discounted settlement will be a significant victory from these levels.
I will go far as to say the facts of the case matter little now as. CHM clearly have an argument accepted by the courts and that is all they need for victory because MMX need to move on with a normalized corporate life....the case cant be "thrown out" as its already in.
