The saga of builder-developer Diploma Group’s $100 million collapse is heading back to court, and this time members of the founding Di Latte family will be front and centre.
Liquidators from Grant Thornton have issued summonses to about half a dozen former officers of Diploma and its subsidiaries to appear in the Supreme Court for public examinations. It’s aimed at progressing the liquidators’ probe into the firm’s affairs.
No names mentioned but we can expect the list to include former executive chairman Nick Di Latte, his father and company founder Domenic Di Latte, sister Natalina De Felice and uncle Salvatore Di Latte.Those summonsed have been given until next Thursday to produce written records ahead of court appearances expected in the first few months of next year
A provisional liquidators report tendered to the Federal Court last year said it was suspected Diploma directors and officers might have broken the law through uncommercial transactions, unreasonable director-related transactions, unfair loans and trading while insolvent
The Di Lattes have denied any wrongdoing.It’s understood that corporate watchdog the Australian Securities and Investments Commission has been providing funding for the liquidators’ investigations
Sub-contractors and suppliers who remain unpaid nearly two years after Diploma’s collapse will be following developments with interest.
