I think defence centres around a couple of issues.....
Contrary to some postings here regarding..

1/ 2 CHM cheques totalling approx $150,000 paid to Winterfall as part payment for JH...chm claim Misappropriated..MMX claim a loan between companies!!...Zuks who was a witness testified that Grim and Barnes said they were a loan!!...both companies apparently have entries to that effect in thier loan account books!!..On that basis Seems pretty difficult to argue and prove otherwise.. although that is what chm are trying to do....I would suggest MMX have not repaid a loan and will now be forced to do so, with interest and compensation..

2/ Grim allegedly recieved shares in chm and then sold them and put "some" of the proceeds into MMX to again partially fund purchase....Now, if as is claimed, a large percentage of these shares were Grim's legitimately,as payment, how can you prove beyond doubt that the proceeds from only the illegitimate shares(If indeed they were) were the funds that went into JH, It is an arguement, granted, But Seems pretty vague and difficult to prove to me...
