My interest is as a potential buyer. I was curious why the price dropped so much on the 27th Feb 2016 and I did research.
The IPH prospectus identified a number of key risks, including ‘regulatory environment’, at page 14 and on page 44 at 4.1.2. This risk to the profits of the group specifically relates to patent attorney committing unsatisfactory professional conduct, which is directly relevant given the court decision.
The next risk identified in the prospectus was 4.1.3 regulatory reform which was not expected to take effect until 2016. Well it is now 2016. The proposed trans-tasman single economic market was identified as a significant overall risk that the group will generate lower revenues by virtue of proposed changes. As I understand it the Australian legislation is now in force and the counterpart New Zealand legislation recently (9 February 2016) had its first reading. Apparently the New Zealanders are under time pressure to enable their legislation due to a sunset clause in the Australian legislation. Does anyone know the likely impact of this change on revenues and ongoing profits?
