It is not my slant that he misled and deceived clients over numerous years, this is the outcome of the proceedings (par 101). The proven charges cover 2005 to 2010 and 2010 to 2012 and relate to “conduct which was misleading or deceptive”.
The PSB did not to cancel or suspend his registration but its power is protective rather than penal (par 113).
The issues were sufficiently serious that he was found guilty of unsatisfactory professional conduct. The decision states that Mr X was not informed about a court case involving his patent in the USA (par 44) and the possibility of commercial ramifications. The other matter involved the lapsing of a patent and withholding of this information from the client.
The issue is the publication of the decision on the 27^th February 2016. As noted at par 114 “One can be confident that these proceedings and my findings will become public knowledge…”. The lawyer client relation is one of trust and if you can’t trust your lawyer to tell you what is happening then who can you trust? It is a PR problem for IPH.
