We could argue about it till the cows come home, but it is the law that banks are the entity that needs to be responsible in such contracts - they know it or they should know it..
Both parties are at fault I guess so make them split the lose, if any, and then fine the bank for breaching it’s lawful obligation..it seems a pretty straight forward solution ain’t it.
