If you look at the forms/ criteria (which I have done in the past) - its not so easy to make an application - you have to show specific incidents and provide written evidence. Most of the evidence is hearsay and can be disputed easily. ie People talk to management and hear snippets of info that can be interpreted a multitude of ways. The onloy wa you could use this if you have a transcript of the call but unless you have notified them the call is recorded I doubt it could be used and if you told them you were recording the converdsation I doubt they would talk.

We have around 6 weeks till the end of the quarter so hopefully we have good news before then. The cash burn rate must be getting spent on something.... If nothing happens you can be pretty certain that they're done and your money is a lost - Too bad we can't write it down against other tax as there is no specific capital event, we're just in limbo till they call quits.
