THE COURT ORDERS THAT:
1. Pursuant to Order 13 Rule 2 of the Federal Court Rules the First Respondent and Fourth Respondent have leave to amend the Defence and Cross-claims of the First and Fourth Respondent in terms of the Minute of Amended Defence and Cross-claim dated 28 July 2008.
2. The Minute of Amended Defence and Cross-claims stand as the First and Fourth Respondents’ Amended Defence and Cross-claims and service of the Amended Defence and Cross-claims be dispensed with.
3. The First and Fourth Respondents pay the other parties’ costs thrown away by reason of the amendment of the Defence and Cross-claims, in any event.
4. Pursuant to Order 72 of the Federal Court Rules, the parties engage in mediation on 8 September 2008 with a mediator to be agreed between the parties.
5. The orders made on 12 May 2008 relating to the provision of security for costs by the Applicant as against the First, Third, Fourth and Fifth Respondents are stayed until 9 September 2008; the orders made on 12 May 2008 relating to the provision of security for costs by the Applicant as against the Second Respondent are not stayed.
6. The Applicant is to file and serve its Reply by 22 August 2008.
7. The proceedings be listed for further directions on 12 September 2008 at a time to be fixed.
8. The parties have liberty to apply on 1 day’s notice.
