Total rubbish that they can surreptitiously turn a Phase 1b stand alone trial (planned) to be followed by a Phase 2 trial (some) of whose parameters will be determined by Phase 1b results, into a combined Phase 1b/2 trial.
Absolutely no way they can get out of reporting at least top line Phase 1b results particularly wrt their influence on Phase 2 design.
Shareholders MUST be informed. Otherwise I (along with the bulk of 'in the dark' shareholders, I would hope) will be making strong representations to ASIC in an attempt to force their hand.
The whole idea is ludicrous.
